RECENT RULES ORDERS


Pursuant to Article VIII Section 3 of the West Virginia Constitution, the Supreme Court of Appeals of West Virginia "shall have power to promulgate rules for all cases and proceedings, civil and criminal, for all the courts of the State relating to writs, warrants, process, practice and procedure, which shall have the force and effect of law." See also W. Va. Code 51-1-4. The Court exercises this authority by issuing rules orders at various times throughout the year. Listed below, in reverse chronological order, are links to recent rules orders issued by the Court, along with a brief explanation of each. The Court has entered an order adopting amendments to Bylaws 1.01, 2.02, 3.02, 3.03, 5.08, and 13.02 of the West Virginia State Bar Bylaws.

The Court has entered an order adopting amendments to Rule 1 of the Rules of Appellate Procedure.

The Court has entered an order provisionally adopting and calling for public comments to Rule 37a of the Rules of Practice and Procedure for Family Court. All comments must be filed in writing with the Clerk of Court no later than October 30, 2025.

The Court has entered an order refusing to adopt proposed amendments to Comment 11 to Rule 1.7 of the Rules of Professional Conduct.
