RECENT RULES ORDERS

Pursuant to Article VIII Section 3 of the West Virginia Constitution, the Supreme Court of Appeals of West Virginia "shall have power to promulgate rules for all cases and proceedings, civil and criminal, for all the courts of the State relating to writs, warrants, process, practice and procedure, which shall have the force and effect of law." See also W. Va. Code 51-1-4. The Court exercises this authority by issuing rules orders at various times throughout the year. Listed below, in reverse chronological order, are links to recent rules orders issued by the Court, along with a brief explanation of each. The Court has entered an order adopting amendments to Rule 17 of the West Virginia Trial Court Rules.

The Court has entered an order adopting amendments to Rules 2 and 27 of the West Virginia Rules of Practice and Procedure for Domestic Violence Civil Proceedings.

The Court has entered an order requesting public comment on proposed amendments to Bylaws 1.01, 2.02, 3.02, 3.03, 5.08, and 13.02 of the West Virginia State Bar Bylaws.

The Court has entered an order provisionally adopting and calling for public comments on proposed amendments to Rules 3 and 15 of the Rules of Procedure for Child Abuse and Neglect Proceedings. All comments must be filed in writing with the Clerk of Court no later than May 26, 2025.

The Court has entered an order requesting public comment on proposed amendments to Rule 17of the West Virginia Trial Court Rules regarding disqualification and temporary assignment of judges. Comments must be filed with the Clerk of Court on or before April 28, 2025.
