RECENT RULES ORDERS


Pursuant to Article VIII Section 3 of the West Virginia Constitution, the Supreme Court of Appeals of West Virginia "shall have power to promulgate rules for all cases and proceedings, civil and criminal, for all the courts of the State relating to writs, warrants, process, practice and procedure, which shall have the force and effect of law." See also W. Va. Code 51-1-4. The Court exercises this authority by issuing rules orders at various times throughout the year. Listed below, in reverse chronological order, are links to recent rules orders issued by the Court, along with a brief explanation of each. RE: Provisional Approval and Publication of Rules and Court Forms for Financial Exploitation Actions: By order entered June 4, 2019, the Court upon consideration and review is of opinion and does hereby provisionally approve and adopt the Rules of Practice and Procedure for Financial Exploitation Civil Proceedings and forms in relation to these rules.

RE: Request for Public Comment on Proposed Amendment to Rule 6 of the West Virginia Rules of Procedure for Child Abuse and Neglect Proceedings: By order entered June 4, 2019, the Court is of the opinion to and does hereby approve a period of public comment to proposed amendments to Rule 6 of the West Virginia Rules of Procedure for Child Abuse and Neglect Proceedings. The comment period ends August 6, 2019.

RE: Adoption, in part, of Amendments to the Rules of Judicial Disciplinary Procedure and the Rules for Admission to the Practice of Law: By order entered February 13, 2019, upon consideration and review, the Court is of the opinion to and does hereby adopt the amendments to Rule 1.9 of the Rules of Judicial Disciplinary Procedure and Rule 1.0(a) of the Rules for Admission to the Practice of Law, as modified since publication for comment, effective immediately. The Court is of the opinion to and does hereby decline to adopt amendments to Rule 1.2 and 1.6 of the Rules of Judicial Disciplinary.

RE: Adoption of Amendments to Rule 8 of the Administrative Rules for the Magistrate Courts of West Virginia: By order entered February 1, 2019, upon consideration and review of the proposed amendment, together with the comments filed, the Court is of the opinion and does hereby adopt the amendment to Rule 8, effective immediately.

RE: Request for Public Comment on Proposed Amendments to the Rules for Admission to the Practice of Law: By order entered June 12, 2018, the Court is seeking comment on proposed amendments to the Rules for Admission to the Practice of Law. The comment period ends August 14, 2018.

RE: Request for Public Comment on Proposed Amendments to Rule 8 of the Administrative Rules for the Magistrate Courts of West Virginia: By order entered June 5, 2018, the Court is seeking comment on proposed amendment to Rule 8 of the Administrative Rules for the Magistrate Court of West Virginia regarding reimbursement to magistrates for their telephone services. The comment period ends July 5, 2018.

RE: Request for Public Comment on Proposed Revisions to the Governance Documents of the West Virginia State Bar - West Virginia State Bar Constitution, West Virginia State Bar Bylaws, West Virginia State Bar Administrative Rules, and Definition of the Practice of Law: By order entered May 9, 2018, the Court is seeking comment on proposed changes to the Governance Documents of the West Virginia State Bar. The comment period shall last for a period of ninety-days.

RE: Provisional Adoption of and Request for Public Comment on Proposed Amendments to the Rules of Judicial Disciplinary Procedure and the Rules for Admission to the Practice of Law: By order entered May 9, 2018, the Court is of the opinion that the proposed amendments should be provisionally adopted, subject to being published for a thirty-day public comment period.
