RECENT RULES ORDERS


Pursuant to Article VIII Section 3 of the West Virginia Constitution, the Supreme Court of Appeals of West Virginia "shall have power to promulgate rules for all cases and proceedings, civil and criminal, for all the courts of the State relating to writs, warrants, process, practice and procedure, which shall have the force and effect of law." See also W. Va. Code 51-1-4. The Court exercises this authority by issuing rules orders at various times throughout the year. Listed below, in reverse chronological order, are links to recent rules orders issued by the Court, along with a brief explanation of each. RE: Adoption of Amendments after Request for Public Comment on Amendments to Rules Relating to Electronic Filing, Specifically, Trial Court Rules 11.02 and 15A and Rule 6 of the Rules of Practice and Procedure for Family Courts: By order entered September 12, 2019, the Court is of the opinion that the proposed amendments should be adopted, effective November 1, 2019.

RE: Provisional Adoption of and Request for Public Comment on Proposed Amendments to the Rules of Judicial Disciplinary Procedure: By order entered September 5, 2019, the Court is of the opinion that the proposed amendments should be provisionally adopted, subject to being published for a thirty-day period of public comment. Comments must be filed in writing with the Clerk of the Court on or before October 11, 2019.

RE: Request for Public Comment on Proposed Amendment to the West Virginia Rules of Juvenile Procedure: By order entered June 19, 2019, the Court is of the opinion that the proposed amendment should be published for comment for a period of thirty days. Comments must be filed in writing with the Clerk of Court on or before July 19, 2019.

RE: Request for Public Comment on Proposed Amendments to the West Virginia Rules of Procedure for Child Abuse and Neglect Proceedings: By order entered June 19, 2019, the Court is of the opinion that the proposed amendments should be published for comment for a period of thirty days. Comments must be filed in writing with the Clerk of Court on or before July 19, 2019.

RE: Request for Public Comment on Amendments to Rules Relating to Electronic Filing, Specifically, Trial Court Rules 11.02 and 15A and Rule 6 of the Rules of Practice and Procedure for Family Courts: By order entered June 10, 2019, the Court is seeking comment on proposed amendments to the rules relating to electronic filing. Comments must be filed in writing with the Clerk of Court on or before July 26, 2019.

RE: Provisional Approval and Publication of Rules and Court Forms for Financial Exploitation Actions: By order entered June 4, 2019, the Court upon consideration and review is of opinion and does hereby provisionally approve and adopt the Rules of Practice and Procedure for Financial Exploitation Civil Proceedings and forms in relation to these rules.

RE: Request for Public Comment on Proposed Amendment to Rule 6 of the West Virginia Rules of Procedure for Child Abuse and Neglect Proceedings: By order entered June 4, 2019, the Court is of the opinion to and does hereby approve a period of public comment to proposed amendments to Rule 6 of the West Virginia Rules of Procedure for Child Abuse and Neglect Proceedings. The comment period ends August 6, 2019.

RE: Adoption, in part, of Amendments to the Rules of Judicial Disciplinary Procedure and the Rules for Admission to the Practice of Law: By order entered February 13, 2019, upon consideration and review, the Court is of the opinion to and does hereby adopt the amendments to Rule 1.9 of the Rules of Judicial Disciplinary Procedure and Rule 1.0(a) of the Rules for Admission to the Practice of Law, as modified since publication for comment, effective immediately. The Court is of the opinion to and does hereby decline to adopt amendments to Rule 1.2 and 1.6 of the Rules of Judicial Disciplinary.

RE: Adoption of Amendments to Rule 8 of the Administrative Rules for the Magistrate Courts of West Virginia: By order entered February 1, 2019, upon consideration and review of the proposed amendment, together with the comments filed, the Court is of the opinion and does hereby adopt the amendment to Rule 8, effective immediately.
