RECENT RULES ORDERS


Pursuant to Article VIII Section 3 of the West Virginia Constitution, the Supreme Court of Appeals of West Virginia "shall have power to promulgate rules for all cases and proceedings, civil and criminal, for all the courts of the State relating to writs, warrants, process, practice and procedure, which shall have the force and effect of law." See also W. Va. Code 51-1-4. The Court exercises this authority by issuing rules orders at various times throughout the year. Listed below, in reverse chronological order, are links to recent rules orders issued by the Court, along with a brief explanation of each. RE: Adoption of Proposed Amendments to the Administrative Rules for the Magistrate Courts of West Virginia by order entered January 9, 2020, the Court did not receive any comments to the proposed amendments. Upon consideration of the amendments, the Court is of the opinion to and does hereby adopt the proposed rule amendments.

RE: Approval and Adoption of Revisions to the Governance Documents of the West Virginia State Bar – West Virginia State Bar Constitution, West Virginia State Bar Bylaws, West Virginia State Bar Administrative Rules, and Definition of the Practice of Law by order entered December 30th, 2019 and effective January 1, 2020, the State Bar Governance documents are adopted.

RE: Provisional Adoption of and Request for Public Comment on Proposed Amendments to Rule 1C of the Administrative Rules for the Magistrate Courts of West Virginia by order entered October 31, 2019, the Court is of the opinion that the proposed amendments should be provisionally adopted, subject to being published for a thirty-day period of public comment. Comments must be filed in writing with the Clerk of Court on or before December 2, 2019.

RE: Adoption of Proposed Amendments to the Rules of Judicial Disciplinary Procedure by order entered October 31, 2019, upon consideration of the amendments, the Court is of the opinion to and does hereby adopt the proposed rule amendment to Rule 4.12 of the Rules of Judicial Disciplinary Procedure.

RE: Provisional Adoption of and Request for Public Comment on Proposed Amendments to the Administrative Rules for the Magistrate Courts of West Virginia by order entered October 28, 2019, upon consideration of proposed amendments to Rule 7(a)(4) of Administrative Rules for the Magistrate Courts of West Virginia, the Court is of the opinion that proposed amendments should be provisionally adopted, subject to being published for a thirty-day period of public comment. Comments must be filed in writing with the Clerk of the court on or before December 6, 2019.

RE: Adoption of Amendments after Request for Public Comment on Amendments to Rules Relating to Electronic Filing, Specifically, Trial Court Rules 11.02 and 15A and Rule 6 of the Rules of Practice and Procedure for Family Courts: By order entered September 12, 2019, the Court is of the opinion that the proposed amendments should be adopted, effective November 1, 2019.

RE: Provisional Adoption of and Request for Public Comment on Proposed Amendments to the Rules of Judicial Disciplinary Procedure: By order entered September 5, 2019, the Court is of the opinion that the proposed amendments should be provisionally adopted, subject to being published for a thirty-day period of public comment. Comments must be filed in writing with the Clerk of the Court on or before October 11, 2019.

RE: Request for Public Comment on Proposed Amendments to the West Virginia Rules of Procedure for Child Abuse and Neglect Proceedings: By order entered June 19, 2019, the Court is of the opinion that the proposed amendments should be published for comment for a period of thirty days. Comments must be filed in writing with the Clerk of Court on or before July 19, 2019.

RE: Request for Public Comment on Proposed Amendment to the West Virginia Rules of Juvenile Procedure: By order entered June 19, 2019, the Court is of the opinion that the proposed amendment should be published for comment for a period of thirty days. Comments must be filed in writing with the Clerk of Court on or before July 19, 2019.

RE: Request for Public Comment on Amendments to Rules Relating to Electronic Filing, Specifically, Trial Court Rules 11.02 and 15A and Rule 6 of the Rules of Practice and Procedure for Family Courts: By order entered June 10, 2019, the Court is seeking comment on proposed amendments to the rules relating to electronic filing. Comments must be filed in writing with the Clerk of Court on or before July 26, 2019.
