RECENT RULES ORDERS


Pursuant to Article VIII Section 3 of the West Virginia Constitution, the Supreme Court of Appeals of West Virginia "shall have power to promulgate rules for all cases and proceedings, civil and criminal, for all the courts of the State relating to writs, warrants, process, practice and procedure, which shall have the force and effect of law." See also W. Va. Code 51-1-4. The Court exercises this authority by issuing rules orders at various times throughout the year. Listed below, in reverse chronological order, are links to recent rules orders issued by the Court, along with a brief explanation of each. REQUEST FOR PUBLIC COMMENT ON PROPOSED CHANGES TO THE CODE OF JUDICIAL CONDUCT By order entered June 28, 2013, the Court requested public comment on proposed amendments to the Code of Judicial Conduct. The ninety-day comment period ends on September 26, 2013, and all comments must be filed in writing with the Clerk of Court. For the convenience of review, a strikethrough version and an engrossed version are provided.

APPROVAL OF AMENDMENTS TO RULE 8 of the WEST VIRGINIA TRIAL COURT RULES By Order entered June 18, 2013, the Court approved amendments to Rule 8 of the West Virginia Trial Court Rules, governing Cameras, Audio Equipment, and Media in the Courtroom.

REQUEST FOR COMMENTS ON PROPOSED AMENDMENTS TO RULE 8 of the WEST VIRGINIA TRIAL COURT RULES By Order entered May 1, 2013, the Court requests public comment on proposed amendments to Rule 8 of the West Virginia Trial Court Rules, governing Cameras, Audio Equipment, and Media in the Courtroom. The public comment period ends May 31, 2013.

AMENDMENTS TO RULE 4 AND RULE 11, RULES OF PRACTICE AND PROCEDURE FOR DOMESTIC VIOLENCE CIVIL PROCEEDINGS By Order entered February 21, 2013, relating to service of process of protective orders and relating to payment of the fee authorized by Rule 4 to any law enforcement agency that serves the pleadings or orders.

AMENDMENTS TO RULE 43 OF THE W. VA. RULES OF CIVIL PROCEDURE AND RULE 56 OF THE RULES OF PRACTICE AND PROCEDURE FOR FAMILY COURT by Order entered February 7, 2013, which addresses the payment of compensation to interpreters as provided by law.

ADOPTION OF AMENDMENTS TO THE RULES FOR ADMISSION TO THE PRACTICE OF LAW By Order entered November 20, 2012, the Court adopted the amendments to the Rules for Admission to the Practice of Law effective January 1, 2013.

GUIDELINES FOR KANAWHA COUNTY PILOT DOMESTIC VIOLENCE COURT By Order entered November 20, 2012, the Court approved the proposed guidelines for the Domestic Violence Court Pilot Project in Kanawha County as created by the Legislature at W. Va. Code § 48-37-301 and § 51-2A-2, effective immediately.

DECLINING TO ADOPT PROPOSED AMENDMENTS TO WEST VIRGINIA STATE BAR RULES AND REGULATIONS, CHAPTER VII. RULES TO GOVERN MANDATORY CONTINUING LEGAL EDUCATION. By Order entered September 20, 2012, the Court declined to adopt the proposed amendments.
