ARCHIVED RULES ORDERS


Pursuant to Article VIII Section 3 of the West Virginia Constitution, the Supreme Court of Appeals of West Virginia "shall have power to promulgate rules for all cases and proceedings, civil and criminal, for all the courts of the State relating to writs, warrants, process, practice and procedure, which shall have the force and effect of law." See also W. Va. Code 51-1-4. The Court exercises this authority by issuing rules orders at various times throughout the year. Listed below, in reverse chronological order, are links to recent rules orders issued by the Court, along with a brief explanation of each. The Court has entered an order retiring the "Affidavit: Eligibility for Appointed or Public Defender Counsel" form.

The Court has entered an order adopting the following revised forms: "Allowances to Senior Status Family Court Judges", "Allowances to Senior Status Magistrates", and "Senior Status Circuit Court Judges Per Diem/Travel".

The Court has entered an order adopting the following revised forms: "Request for Order or Warrant for Arrest: Violation of Home Incarceration and/or Probation" and "Order Granting or Denying Request for Order or Warrant for Arrest: Violation of Home Incarceration and/or Probation".

The Court has entered an order adopting the following revised court forms: "Order Appointing Guardian Ad Litem: Court-Funded", "Order Appointing Guardian Ad Litem: Payment by Parties", "Order Recommending Payment by Supreme Court: Appointed Guardian Ad Litem", "Order Approving Payment by Parties: Appointed Guardian Ad Litem", and "Court Invoice for Guardian Ad Litem".

The Court has entered an order adopting the "Allowances to Circuit Court Judges for Mileage and Per Diem" form.

The Court has entered an order approving amendments to the "Supreme Court of Appeals of West Virginia Application for Temporary Family Court Judge".

The Court has entered an order updating the "West Virginia Supreme Court of Appeals Application for Senior Status for Retired Judges" for use as the "West Virginia Supreme Court of Appeals Application for Senior Status for Retired Family Court Judges".

The Court has entered an order adopting amendments to the "Petition for Divorce Instructions" and "Respondent's Divorce Answer Packet Instructions" forms.

The Court has entered an order adopting amendments to the "Guilty or No Contest Plea" form.

The Court has entered an order adopting amendments to Rules 3 and 15 of the West Virginia Rules of Procedure for Child Abuse and Neglect Proceedings.
