RECENT RULES ORDERS


Pursuant to Article VIII Section 3 of the West Virginia Constitution, the Supreme Court of Appeals of West Virginia "shall have power to promulgate rules for all cases and proceedings, civil and criminal, for all the courts of the State relating to writs, warrants, process, practice and procedure, which shall have the force and effect of law." See also W. Va. Code 51-1-4. The Court exercises this authority by issuing rules orders at various times throughout the year. Listed below, in reverse chronological order, are links to recent rules orders issued by the Court, along with a brief explanation of each. RE: Request for Public Comment on Proposed Amendments to Rule 8 of the Administrative Rules for the Magistrate Courts of West Virginia: By order entered June 5, 2018, the Court is seeking comment on proposed amendment to Rule 8 of the Administrative Rules for the Magistrate Court of West Virginia regarding reimbursement to magistrates for their telephone services. The comment period ends July 5, 2018.

RE: Request for Public Comment on Proposed Revisions to the Governance Documents of the West Virginia State Bar - West Virginia State Bar Constitution, West Virginia State Bar Bylaws, West Virginia State Bar Administrative Rules, and Definition of the Practice of Law: By order entered May 9, 2018, the Court is seeking comment on proposed changes to the Governance Documents of the West Virginia State Bar. The comment period shall last for a period of ninety-days.

RE: Provisional Adoption of and Request for Public Comment on Proposed Amendments to the Rules of Judicial Disciplinary Procedure and the Rules for Admission to the Practice of Law: By order entered May 9, 2018, the Court is of the opinion that the proposed amendments should be provisionally adopted, subject to being published for a thirty-day public comment period.

RE: Request for Public Comment on Proposed Amendments to Rule 38 of the Rules of Appellate Procedure (Addressing the placement of citations in a document): By order entered March 14, 2018, the Court is considering an amendment to Rule 38 of the Rules of Appellate Procedure regarding the placement of citations in documents filed with the Court.

RE: ADOPTION OF AMENDMENT TO RULE 17.05 OF THE TRIAL COURT RULES: By order entered February 14, 2018, the Court is of the opinion and does hereby adopt proposed amendment to rule 17.05 of the Trial Court Rules.

RE: Request for Public Comment on Proposed Amendments to Rule 1.2 of the Rules of Professional Conduct (Addressing the West Virginia Medical Cannabis Act): By order entered January 10, 2018, The Court is considering an amendment to Rule 1.2 of the Rules of Professional Conduct. The proposed amendment is hereby published for a thirty-day public comment period.
