St. Mary’s Medical Center, Inc. v. Steel of West Virginia, Nos. 16-1101 & 16-1032 - Petitioners St. Mary’s Medical Center, Pallottine Health Services, and West Virginia Attorney General Patrick Morrisey filed separate appeals of two October 28, 2016, orders of the Circuit Court of Kanawha County requiring production of certain documents related to the proposed sale of St. Mary’s Medical Center. The documents at issue were requested by a third-party through a Freedom of Information Act request served upon Attorney General Morrisey. Petitioners argue that the circuit court erred in requiring the disclosure of these documents, as said documents were exempt from disclosure by West Virginia Code §§ 29B-1-4(a)(1) and (5), and West Virginia Code § 47-18-7(d). Further, Petitioners St. Mary’s and Pallottine appeal the circuit court’s October 28, 2016 order denying their motion to intervene and argue that the circuit court erred in finding that their interests were adequately represented by the existing parties.

Steel of West Virginia v. West Virginia Health Care Authority, No. 17-0406 - Petitioner appeals the circuit court’s April 19, 2017, “Final Order” that affirmed the West Virginia Health Care Authority’s decision to issue a certificate of need to Cabell Huntington Hospital in its purchase of St. Mary’s Hospital. WITHDRAWN.

Verizon Services Corp. v. Board of Review Workforce WV, No. 17-0288 - Verizon appeals the circuit court’s order affirming the Board of Review’s decision that upheld the Labor Dispute Tribunal’s decision that the Respondent claimants are not disqualified from receiving unemployment compensation benefits related to a labor dispute.
