RECENT RULES ORDERS
 

Pursuant to Article VIII Section 3 of the West Virginia Constitution, the Supreme Court of Appeals of West Virginia "shall have power to promulgate rules for all cases and proceedings, civil and criminal, for all the courts of the State relating to writs, warrants, process, practice and procedure, which shall have the force and effect of law." See also W. Va. Code 51-1-4. The Court exercises this authority by issuing rules orders at various times throughout the year. Listed below, in reverse chronological order, are links to recent rules orders issued by the Court, along with a brief explanation of each. The Court has entered an order adopting amendments to Rules 3.2 and 4.4 of the West Virginia Rules for Admission to the Practice of Law.

The Court has entered an order abrogating Rule 6.04 of the West Virginia Trial Court Rules.

The Court entered an order requesting public comment on proposed amendments to Bylaw 2.07 of the West Virginia State Bar Bylaws. All comments must be filed in writing with the Clerk of Court no later than July 27, 2026.

The Court has entered an order adopting amendments to Rule 38A of the West Virginia Rules of Appellate Procedure.

The Court entered an order requesting public comment on proposed amendments to West Virginia State Bar Bylaw 2.07. All comments must be filed in writing with the Clerk of Court no later than July 27, 2026.

The Court refuses to adopt proposed amendments to the West Virginia Rules of Juvenile Procedure.

The Court entered an order requesting public comment on proposed amendments to Administrative Rules 13.03, 13.04, 13.06, 13.08, 13.09, 13.10, 13.11, 13.12, 13.13, and 13.14 of the West Virginia State Bar Administrative Rules. All comments must be filed in writing with the Clerk of Court no later than July 27, 2026.

The Court entered an order requesting public comment on proposed amendments to Bylaws 5.02, 5.03, 5.04, 5.05, 5.06, 5.07, 5.07, 5.09, 5.10, 5.11, and 5.12 of the West Virginia State Bar Bylaws. All comments must be filed in writing with the Clerk of Court no later than July 27, 2026.

The Court has entered an order adopting amendments to Rule 21 of the West Virginia Rules of Appellate Procedure.

The Court entered an order requesting public comment on proposed amendments to the Code of Judicial Conduct. All comments must be filed in writing with the Clerk of Court no later than July 8, 2026.
