RECENT RULES ORDERS


Pursuant to Article VIII Section 3 of the West Virginia Constitution, the Supreme Court of Appeals of West Virginia "shall have power to promulgate rules for all cases and proceedings, civil and criminal, for all the courts of the State relating to writs, warrants, process, practice and procedure, which shall have the force and effect of law." See also W. Va. Code 51-1-4. The Court exercises this authority by issuing rules orders at various times throughout the year. Listed below, in reverse chronological order, are links to recent rules orders issued by the Court, along with a brief explanation of each. The Court has entered an order adopting amendments to Rules 3 and 15 of the West Virginia Rules of Procedure for Child Abuse and Neglect Proceedings. 25-256

The Court has entered an order requesting public comment on proposed amendments to Rule 21 of the West Virginia Rules of Appellate Procedure. All comments must be filed in writing with the Clerk of Court no later than January 30, 2026.

The Court has entered an order adopting amendments to Rule 37a of the Rules of Practice and Procedure for Family Court.

The Court refuses to adopt the proposed changes to Rule 26 of the West Virginia Rules of Civil Procedure.

The Court refuses to adopt proposed amendments to the West Virginia Rules of Professional Conduct.

The Court has entered an order abrogating the local rule in the Circuit Court of Kanawha County reflected in an Administrative Order titled "In re: Kanawha County Family Court Procedure for Voluntary Recusal", entered in the Circuit Court of Kanawha County October 20, 2020, and approved by order entered by this Court on October 29, 2020.

The Court has entered an order requesting public comment on proposed amendments to Rules 17.02 and 17.06 of the West Virginia Trial Court Rules. All comments must be filed in writing with the Clerk of Court no later than December 8, 2025.

The Court has entered an order requesting public comment on a proposed amendment to abrogate Rule 6.04 of the West Virginia Trial Court Rules. All comments must be filed in writing with the Clerk of Court no later than December 5, 2025.

10-06-2025

The Court has entered an order requesting public comment on proposed amendments to Rules 10.11 and 10.12 of the West Virginia State Bar Administrative Rules. All comments must be filed in writing with the Clerk of Court no later than November 5, 2025.

The Court has entered an order adopting amendments to Rules 3.02, 4.04, 10.02, 10.09, and 13.10 of the West Virginia State Bar Administrative Rules.
